Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the H4ShFund platform (“Platform”) and its associated services (collectively referred to as “Services”). By using the Platform, you agree to comply with these Terms and acknowledge that you have read and understood them. If you do not agree with these Terms, you must not use the Platform.

1. General Conditions

1.1 Eligibility: By accessing the Platform, you represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction), and that you have the legal capacity to enter into these Terms.

1.2 Account Registration: To access the Platform and use its features, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process, and to update such information if necessary.

1.3 No Financial or Legal Advice: The Platform and its Services are provided for informational purposes only. Nothing on the Platform constitutes financial, investment, or legal advice. You should seek independent professional advice before making any financial decisions.

1.4 Platform Use: You agree to use the Platform solely for lawful purposes and in compliance with these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Prohibited Activities

2.1 You agree not to engage in any of the following activities:

(a) Market Manipulation: Including but not limited to “pump and dump” schemes, wash trading, or any conduct designed to artificially affect the price or volume of any digital asset listed on the Platform.

(b) Fraudulent Activities: Engaging in any fraudulent activities or attempting to deceive the Platform or other users, including providing false or misleading information.

(c) Unauthorized Transactions: Using the Platform to carry out transactions on behalf of other individuals or entities, unless expressly authorized by H4ShFund.

(d) Interfering with Platform Operations: Engaging in actions that could disrupt the normal functioning of the Platform, including using bots, web crawlers, or other automated tools to scrape or interact with the Platform.

(e) Intellectual Property Violations: Uploading or using images or content on the Platform without the proper rights or authorization to do so.

(f) Illegal Activities: Engaging in any activities that violate applicable laws, including but not limited to the laws of the United States, the European Union, or any jurisdiction in which you reside.

(g) Hacking or Unauthorized Access: Attempting to gain unauthorized access to any part of the Platform or its associated systems.

3. Digital Assets and Transactions

3.1 Transactions: H4ShFund allows users to create, manage, and trade digital assets, including tokens and other blockchain-based assets. All transactions made on the Platform are irreversible once executed, and you acknowledge and accept this risk.

3.2 Transaction Fees: You may be charged transaction fees for certain actions performed on the Platform, including the creation and exchange of digital assets. Fees will be disclosed before you finalize any transaction.

3.3 No Guarantees: H4ShFund makes no representations or warranties regarding the liquidity, value, or potential profits of any digital asset created or traded on the Platform.

3.4 Risk Acknowledgment: You acknowledge that investing in digital assets and participating in the DeFi space involves significant financial risks, including the loss of all invested capital. You are solely responsible for any decisions you make in relation to the Platform and its services.

4. Intellectual Property

4.1 Platform Content: All content and materials provided on the Platform, including but not limited to text, logos, designs, images, and code (collectively, the “Content”), are the intellectual property of H4ShFund or its licensors. You may not use, modify, or distribute any part of the Content without the prior written consent of H4ShFund.

4.2 User-Generated Content: By uploading any content to the Platform, you grant H4ShFund a worldwide, royalty-free, transferable license to use, modify, and distribute your content in connection with the Platform’s operations.

5. Liability and Indemnity

5.1 Limitation of Liability: To the fullest extent permitted by law, H4ShFund, its affiliates, and its partners shall not be liable for any direct, indirect, special, incidental, or consequential damages, including but not limited to loss of profits, data, or opportunity, arising from your use or inability to use the Platform, or any transactions conducted on the Platform.

5.2 Indemnification: You agree to indemnify and hold H4ShFund harmless from any claims, losses, damages, or liabilities (including legal fees) arising from:

(a) Your breach of these Terms or any applicable law.

(b) Your use of the Platform and Services.

(c) Any third-party claims arising out of your actions on the Platform.

6. Technology Disclaimer

6.1 As-Is Basis: The Platform is provided “as is” without any warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

6.2 Platform Availability: We do not guarantee the continuous availability of the Platform and may temporarily suspend access for maintenance or other reasons. We are not responsible for any interruptions or delays that may occur.

6.3 Third-Party Links: The Platform may contain links to third-party websites or services. We are not responsible for the content or practices of these third-party sites.

7. Privacy and Data Protection

7.1 Data Collection: We collect and process your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy.

8. Termination

8.1 Termination of Access: H4ShFund reserves the right to suspend or terminate your access to the Platform at any time for any reason, including but not limited to your violation of these Terms.

8.2 Effect of Termination: Upon termination, all of your rights to use the Platform shall cease immediately, but any obligations incurred prior to termination shall remain in effect.

9. Governing Law and Dispute Resolution
